The asylum requests they snapped just when the ship Humanity1 was in Italian waters. Great timing. Thus, the request formulated by the migrants was forwarded to our country and not to Germany (of which the NGO boat flies the flag). The umpteenth standoff with the Italian authorities on immigration concerns the controversial vicissitudes of the Sos Humanity ship and her guests, who – according to what we learn – last November 6 had manifested the “ willingness to request international protection “when they were already in our territorial waters.
The recourse of migrants
The refugees, the NGO said, had expressed their intention “ to the captain, to the crew members “and to the lawyer aboard the ship. Therefore, as stated in the appeal ex art. 700 Cpc viewed by Adnkronos, the migrants themselves have “ put this will in writing they have expressly delegated “their defense attorney at the dispatch of this demonstration to the immigration office of the Catania Police Headquarters, which is territorially competent. Said, done: the request it had been formalized the same day by the lawyer by sending it from his certified e-mail.
The decisive detail on territorial waters
And here is the further detail that it almost seems a mockery. As mentioned, in fact, since the migrants had expressed their asylum requests in Italian waters, Humanity1 proceeded to submit the application to our country, which was then formalized ashore. Otherwise, if the manifestation of the will of the refugees had taken place while the ship was in international waters, the request would have concerned Germany, flag country of the vessel. With respect to this aspect, however, the German NGO declares itself to be a mere transmitter of a bureaucratic procedure that does not concern it.
The risk of a precedent
“ The captain and the defender perform a function of mere transmission of the request for protection of applicants to the competent authorities “, we read in fact in the appeal to the Court of Catania against the Ministries of the Interior, Infrastructures and Defense of our country, carried out by the migrants who remained on board the Humanity1 after the disembarkation of the fragile. Net of the fact that, then, all the passengers would have landed on the mainland, but the move seems destined to create a precedent that risks hindering the government and the recent resolution of the Interior Ministry on landings from NGO ships.
